If the Board came out with a decision tomorrow that modified or overturns the initial decision.... do you think Foelak's ID would still be "actionable"?!

Of course not.

Foelak's ID currently stands for NOTHING. The ONLY way it becomes "actionable" or means ANYTHING is IF the Board of Commissioners AFFIRMS her decision.

The BOARD has ALL the power. They CONTROL the Initial Decision of ANY ALJ.
