The lawsuit may indeed go nowhere, but ZRFY has to pay BlankRome for the defense. As of the last 10-Q the company had less than $300K in cash and was burning through cash at an alarming rate just to pay salaries of the executives.
The lawsuit may be what drives the company into bankruptcy, which could have been the goal: Stop Kay and his cronies from taking people's money and lying to them about the future of the company.
And let's not forget that BlankRome was the same law firm that the Company was relying on to extract cash from the companies that were infringing on ZRFY's patents. That all quietly went away with ZRFY getting nothing.
BR may be a big name in legal circles, but that doesn't mean they can win a case that is meritless, for either plaintiff or defendant.
