I have not fully evaluated the merits of whether the company is deliberately trying to confuse people, but if that is the case, then such deliberate confusion would constitute voter disenfranchisement which is actionable in court.
One can reasonably suspect that Denner has his legal team eyeballing the procedural issues, and if he loses, one can also reasonably suspect that this whole matter will end up in court if there is evidence of deliberate voter disenfranchisement.
