Without knowing the terms, I don't think I could embrace as rosy a scenario as you project here, but I like your theory nonetheless. Amarin was smart to settle this while it had the judge's positive opinion keeping Health Net in the case in its back pocket. It is entirely possible that the judge would have tossed out the case against Health Net at a later date, when he wasn't required to accept Amarin's claims as true prior to the gathering of evidence.

And you're right, Amarin can now try to persuade other insurance companies to at least give it what it got in the Health Net settlement. Unfortunately, Congress, the courts, pharmacies and health insurance companies all seem to think that these foreign generic vultures are the magic answer to lowering health care costs for Americans. As long as that myth persists, they'll all favor generics, even if it means helping them break patent laws.
