I believe the government will wait until the amount in dispute of all remaining lawsuits has become less than $5 billion.

So the recap would not occur until ALL Litigation surrounding the NWS is exhausted, including all appeals?

Recap and release could be done in a restructuring manner that will wipe the current shareholders out. The current price is a reflection of that possibility.
