No, recap/release could happen (according to the 4th Letter Agreement) when the total of all outstanding damage claims has become smaller than $5 billion. This could also be ten outstanding cases with a value in dispute of $500 million each.
So the recap would not occur until ALL Litigation surrounding the NWS is exhausted, including all appeals?
