No, it's a civil lawsuit. But if the SEC or some prosecutor wants to run with this info they could file a criminal case if they wished. But this case is strictly civil - no jail time!

If they drag this into discovery, my guess is only a scapegoat. A naive mid-level employee sitting at the table looking at everyone else and thinking to himself, "Ha ha ha, now which one of you is the sacrificial lamb."
