Eddie Vakser was told by the judge that he and Protek (which has no assets and no money) had to pay for an evaluation of Mr. Barry Mezey to determine competency if Vakser wanted the case to go forward. As I posted previously, that is likely to cost thousands of dollars.
The docket reflects no future hearings and no action. It is possible the judge will set a hearing for dismissal due to lack of prosecution in the near future as Vakser's attorney seems to be taking no action to move the case forward. Of course, Vakser does not want Mezey to actually get discovery as we all know from my legal adventures how badly that goes for the scammer involved!
Case permanently suspended in limbo and should be dismissed due to no evaluation paid for by Vakser as per judges orders Vakser must compl with paying for an evaluation. He's failed to abide by court orders. Truth is he doesn't want discovery as his misappropriations of finances and embezzlement will go to FBI. Give it time. My lien should remain in this case hopefully.
