I respect your observation and it could come to be. Anything is possible and I think we can all agree on that. I will stand by my opinion about tons of 3's not really becoming available. In the long term I believe the deal will be done. That said time will tell and as you all can tell I am paying pretty close attention to the cases and looking for any nuggets along the way. I will report the good and bad in regards to the court cases.
I too agree that BYOC should be counter suing for sure. The whole thing is a real shame for the merger timeline as we have seen. Time will tell what happens here.
