swg_tdr, I'm defining naked shorting you're talking a different animal. Naked shorting is illegal no matter how you twist it. If someone is on the prop desk and is a market maker in amrn he can legitimately short the stock without a borrow that's part of the job description or he can buy a derivative to reduce his risk and the firm's risk.
