I believe what you say is pretty much correct. You even have jury selection where you can try to weed out opinionated jurors. But with a judge, you are stuck with him/her. Although, I must throw in that, having been on a couple of juries, I have come across jury members that were as dumb as rocks.

And then you have the judge(s) who won’t let a jury decide a case(too complex, beyond the ken of a common person), or flat-out overrule an extant jury verdict because it is not supported by the facts or does not follow the law the jury was instructed to follow.

A panel of jurors who believe all cheaper generic drugs should be available to the patient regardless of the costs will not be a good outcome for us. Amarin’s legal team needs to bring home a few key points:

- how this undermining kills innovation for the future. Innovation is the cornerstone of medical advances. There are significant costs associated with the trials and that these costs are repaid with the patent protection.
- tell the jury about the hell the FDA put Amarin through to finish the trial, that the SPA agreement was rescinded and left Amarin in the cold to complete the trial themselves.
- patients should have the benefit of the quality and purity the brand offers, the unique encapsulation that helps retain the quality and helps prevent oxidation.
- patient care should always be number 1 priority over greed.
