The question still remains. Why would a CRO store data in the "wrong" format, when they know what the right format is? They would know, correct? Was it willful sabotage, or complete incompetence? Either way, I still think Cytodyn will recover damages from the trial/arbitration. I expect Sidley/Austin to move forward with the case after Cytodyn gets the data they need.
Notice that Amarex hasn't opened their trap and asked for any damages. I think it becomes clearer every day that Amarex are the ones at fault.
