1) The Rule 36 basically means that they affirm on grounds that the District Court did not abuse its discretion. I have no insight into their exact thought process.
2) I am leaning towards filing the writ of certiorari, but I am still doing some due diligence and brainstorming with North.
3) The argument would be a hybrid argument. See my post 370778 for an initial formulation.
