He has been very careful since then to not put the company in a vulnerable position again. That lawsuit occurred when the company was much more financially vulnerable and could have significantly hurt or halted the company's progress. You can argue that he has been too safe in disseminating information.
To me the repeatedly missed timelines do create a vulnerability If any results are bad. If they are good then no harm, no foul.
