Ya know....that Enbanc decision had some pretty good opinions, from what I remember (judge Brown?) A few of those opinions called out the government swindlers.
And yes, wholeheartedly agree the courts are far too political. Now a days even being influenced by threats from outside fringe groups and from our own congress! Court packing anyone?
there was a rumor (can't recall why someone was so sure but i still call it a rumor) that wallison paid visit or communicated with judges, back door, to influence decision. he is one of the architects of the nws? i also read that most judges are member of federalist society too. very political. use the en banc fully. hope the plaintiff lawyers put everything into it. scotus gave the green light, can't backtrack it.
