jasbg, unfortunately oral arguments does not mean we the CAFC panel ruled we have standing.

The bulk if not all of oral arguments will be devoted to the standing issue, whether that's via intervention (rule 24) or via the fraud exception to the non-party rule.

Having said that, being granted oral arguments indicates that the CAFC at least doesn't think it's a clear cut affirm or that the appeal is frivolous.
