That is merely your opinion. I disagree with you and so do some very powerful lawyers & Steve Adelstein ... and the court itself feels there is enough supporting statute, precedent & evidence to justify a trial.
BTW, it would serve people well to remember that Adelstein won the two previous court cases when Walther's cabal screamed daily that; Adelstein has no chance" and "Adelstein will go to jail!"
Looks to me like the point to be litigated is brilliant and Adelstein's attorneys are not your garden variety ambulance chasers.
The court will do what the court will do ... and it does not natter what any of us say, not in the least
