No, you ignored the rest of the clause, it is the “later” of the two expiration time periods. It does not end in 7 years. It ends 5 years after a biological license is received, assuming that is the “later” of the two contingent events. Obviously that has not occurred. And if they get rejected, that would effectively make the 7 year date the date of expiration.

The quote says that the agreement will remain in force until the later of seven years or 5 years after the first commercial sales of DCVAX_L products pursuant to a BLA or marketing authorization. Since there have been no commercial sales pursuant to a BLA yet, that implies the contract is still in force. Thanks for the info Biosect
