The coming soon safe harbor is a remainder from past regulations, and there is no apparent specific time applicable that is mentioned in any of the info that I've seen, just that it is coming soon, sometime soon. It also was clearly not targeted at people buying shares, but at a very narrow audience.
It took a lot of investigating by interested people to even confirm these bags existed.
