Again I'm a lay person in these matters - so I speak merely out of what I personally feel is simple logic. What you point out - things may be more complicated than that.

Still I don't see any reason for Board not to support KM in trying to back Marjac and rule60 case to the maximum - as EVERYONE involved here' and on Amarin will surely benefit from patents restored :)
