If the method by which they are validating the data is still in process then no, they have not actually had it at all. Not until the final version of the article is agreed upon.
If you recall, to announce TLD, you need a fully agreed upon data set including the synthetically created placebo arm or historical data. So long as the article is in process, there are very likely reasons to not view the data as being capable of being announced. The truth of it and the reason companies go quiet is because any misfire, miscommunication or misstatement partial statement or partial misstatement actually is highly material and both the FDA and the SEC would be concerned as well as ordinary investors who might file suit.
So I think your construct of the reality is incorrect.
