actually, Happy was referring to § 11.42, clinical trial results information specified in sections 402(j)(3)(C) and 402(j)(3)(I) of the Public Health Service Act (42 U.S.C. 282(j)(3)(C) and 42 U.S.C. 282(j)(3)(I)) or in § 11.48, as applicable.
In other words, he wants to poke the NIH with legal measures to enforce that law. But I agree with Flipper its toothless although there has been one recent case in particular where management of a biotech refusing to release topline months after being warned by the NIH got much more than just a fine after a verdict.
