Let's not blame her ethnicity or political background or anything else for a decision that was ultimately upheld by three Federal Circuit judges and the U.S. Supreme Court. The reality of any lawsuit is that the outcome can go many directions depending on the governing laws, the lawyers, the arguments from both sides and the evidence presented at trial. There is a reason that most cases like this settle. Nobody with anything at stake wants to leave so much in the hands of a judge when so much to be decided is subjective and open to interpretation.

I think most of us have repeatedly said that Amarin goofed in its choice of where it brought the lawsuit, in the arguments it made, in the witnesses it had testify and in the written arguments it submitted. The laws seemed to set up a dynamic where decisions were much closer calls than any of us, and probably Amarin's lawyers, thought.

Yes and TJ English wrote a good book about this entitled Born to Kill. It details the horrors of the refugee crisis in Vietnam after we left in 1975 and how that played out on US soil. While we are not trying to blame the decision on anyone’s ethnicity, it would be foolish to not acknowledge the cultural impact that those experiences had on those refugees. Much like the fact there will be scars and cultural impacts on the wave of Afghan refugees that are going around the world now, those lucky enough to get out.

Wars can breed resentment even when they result in a refugee coming to the free US. I’m sure many have mixed feelings but I can understand if they have anti capitalist sentiments after what they have seen and where they have come from.

It’s just a nuanced analysis of the situation, nothing xenophobic about it. God bless the Vietnamese and the Afghans who are now in trouble and I believe many of them will come here and make great contributions to this country.

We just can’t ignore Du’s awful decisions (beyond Amarin) or help but speculate her world view influences her rulings
