Reg FD doesn't apply in this situation because of the insider exception. Those who lent the company money in exchange for proof of TLD success would have signed NDAs. This process makes them temporary insiders per SEC Reg FD. So this isn't a selective disclosure as the lenders are now subject to insider trading regulations.
