Most definitely. If there was any risk in the magistrate judge's recommendations to the district judge, it was that she might say Health Net is a neutral party to the dispute and can be dismissed, especially since there was no precedent.
But she didn't. It looks like Amarin already had some effect on the insurance industry by adding Health Net to the lawsuit. This ruling could put an extra scare into insurance companies, which, after all, aren't known for being risk takers. That's the whole reason anyone buys insurance, for safety and security.
But Amarin should push for settlement here. No reason to get too cute. I'd say it's even ok if the company leaves a little on the table and doesn't get everything it wants. Because a settlement will enable it to say behind the scenes that it won and to strongarm other companies to stop helping the generics.
