Spot on Newbie. If it’s a factual issue, it should be up to a jury to decide. The motion to dismiss will be denied, in my opinion. I have no idea why it’s taking so long for the ruling, however. Typically, at least in Superior Court, rulings are made within a few weeks and it’s been months now. Is the delay related to covid or perhaps the judge directed them to attempt settlement talks before he/she rules? Or can you think of another reason for the delay?
