Yes, most are denied says She :) One of the main reasons is, unless its a legal procedural issue (which Judges will rule on), the system favors a Jury deciding the substantive issues (ie the facts of the case) NOT a lone judge. And the burden for PM to overcome in an MTD is very high... In other words all that HCMC's lawsuit must show is sufficient facts to state a claim to relief that is plausible on its face) (IF the Judge were to deny the MTD, I can almost guarantee HCMC would appeal THAT decision) I like our odds.
