It depends on various factors. Are the damages based on hard facts or soft facts like pain and suffering. This appears to be hard facts. However, two sides come to an agreement for their respective benefit. The defense wants to get out as cheap as possible. The plaintiffs want a guaranteed amount of money not subject to appeal. In this case, the defense has deep pockets and are incredibly influential in Washington where this appeal would be heard. I wouldn’t want to risk that if I were Billy. I think weighing all the factors here a 40% haircut for a settlement seems reasonable to me
