That is actually a very interesting way of looking at it. If they don't show up, they would of course reiterate they are dumb. And I do agree that if they don't show up, the court may toss the appeal although I would love to see any precedent confirming that is possible.
Looking at it from another point of view because I always look at things rationally and not as a cheerleader, can anyone really conclude that the Bolzans are as rich as people really think since they have acted like they barely have 2 nickels to rub together. All I know is that every rich person I know hires top notch lawyers and not someone who barely has ANY and I repeat ANY experience in federal court. Mr. Gottlieb has virtually no experience in the federal courts. Zero. I hate to say it but they are acting like a group of people that believe that GDSI will never collect. I don't believe that but I am starting to wonder if the Bolzans are as rich as people think. If I was a billionaire, I would have hired someone such as Skadden Arps that may have ripped this lawsuit to shreds on day one. Instead, they hired local lawyers who have zero securities litigation experience. Makes you wonder. I've always thought Parabellum was the key to this case because they did their homework. However, maybe they miscalculated. Jobs and Gates and other rich people have miscalculated business ventures. Maybe and so has Parabellum
