Hi I think a “hey we are here;
We are represented ;we will fight for what’s right” is a great idea. Some attorneys won’t write the letter if they don’t generally represent the entity they prefer not to be hired guns ( though I’m
Sure we can find one) . That is what I have from the start that letting him know we won’t roll over is a good idea and may result in changing course of his conduct.

To that end we could write our own letter advising we are in process of retaining class action counsel…….

No. I have enquired of a couple. Once you sign the retainer, the lawyers are basically locked in, so if things do escalate they will need to be more heavily involved.
