Yes indeed! My ideal scenario is that this ends quickly and favorably. Judge Du hammers them for not responding to the Rule 60, and states that she needs no further briefing or even oral argument.

She acknowledges in a thoughtful, written opinion that the ruling invalidating the patents should be reversed on grounds of Mistake (in reliance upon Curfman/Bhatt, Jarvis, Hindu Kush, applicable law) pursuant to Rule 60(b)(1). Because the Court is reversing on grounds of Mistake, the Court need not reach any of the fraud allegations as moot.
