Crash report proves hes telling the turth. EDR data indicates he never took his foot off the accelerator in the second leading up to the crash showing that the case is not an example of pedal misapplication. No instead its accelerator pedal sensors giving false readings most likely due to voltage depression.

 It's all because a bad throttle position sensor is sending garbled messages to the engine computer. You may experience:

Poor acceleration

Surging acceleration

Hesitation

Sudden acceleration when you are not pushing the gas pedal

Inability to travel at higher speeds

Bucking and jerking



Yes this example is for ICE but the sensors are the same in principle.

ACCELERATOR PEDAL SENSOR FAULTY: CAUSE OF FAILURE

A failure could have a number of different causes:

Damaged cables or connections on the accelerator pedal sensor

Missing voltage and ground supply

Faulty electronic evaluation unit in the sensor



Current induction causes voltage depression.
