This is my take on why the “unblind” disclosure was handled the way it was. There’s no question in anyone’s mind that the company is unblinded for a whole host of reasons. So why did they leave that issue open ended in the 10K?

Similarly, although we believe the interim blinded data from the Phase III trial that we have collected and reported to date are encouraging, the results of this trial when the data are unblinded may not be as encouraging or may not be positive at all.


Sticking with my mantra that the company is being prep’ed to be sold, they (either Merck or NWBO) don’t want any potential legal holes in the financials that my aid in some type of lawsuit or legal action, which would then be the responsibility of the acquisition company to defend.

I have no idea how not saying the trial is unblinded or having the risk factors so open ended would limit any legal risk. But lawyers can use information and statements to connect what might seem like unrelated evidence to make a legal case. In short, I think they’re exercising an abundance of caution for how those disclosures or absence therein are reflected in the 10K.

I disagree with your opinion at the end of your post. Instead, it’s very clear they intended to persuade the reader that they (management) were not yet ”unblinded” as of at least December 2020. Couldn’t possibly read it any other way, unless they were misleading the public, and I don’t think they’d do that on the most critical matter in the historical existence of the company.

Thanks for posting all the detail Senti . . . This is very simple.
If fartstain really had the goods on NWBO he would have been more specific with the dates they became unblinded and the dates the end points were changed. Without specifics he is just shooting blind from the hip. NWBO told us the would not data lock until the final SAP was complete which means the endpoint modifications had to have happened before October 2020.
