we don't truly know that for sure....and we won't until AMRN is given time to respond. I am sure their legal counsel is reviewing it in its totality which will take time - and if AMRN can use this means to get Bhatt's paper before the court for reconsideration - it will.
Perhaps Rules 24/60 would have been seen as a ploy by the court had AMRN taken the lead early on....and perhaps the court will consider differently after seeing AMRN did not have its hands on the initial submission.
