The issue of future licensing is debatable. The patents have just about run their course, so at this point it is more about past infringement. Also the time frame to file suits is almost up. It is possible the patents could be extended, but that hasn't happened yet. Also the contingency fee, whatever the amount may be (all just speculation on here), applies to the suit for ATVI, not necessarily all of the other infringers. We are not privy to what agreement WDDD has with S&G regarding future lawsuits and other infringers.
