I'm not a lawyer but I think I know the answer to this one (for a change). If you read Amarin's request to SC they mentioned that SC should take their case or at least remand back to the circuit court to decide using appropriate graham rules and objective indicia.
The fact the Circuit court gave us a Rule 36 (even with Judge Reyna on the bench) makes me hesitant going back to them.
Longest of long shots but come on SCOTUS! Hear us out!
