That is fair to say.
Just because the SEC has not uploaded their response brief as of yet doesn’t mean it was not filed. There is no regulation stating a timeframe as to how long they have to upload their brief in response to the PFR being granted so it could be uploaded at anytime.
Until there is something posted being either a brief from the SEC or a final determination from the SEC Commission it’s all speculation one way or the other.
Either that or the other way would be for DBMM to put out a PR stating the case is over. Without more info from one side or the other it’s all just an opinion one way or the other
