If they are only "Patent Pending" then nothing will be published unless they are granted.

And, you know how "Patent Pending" goes -- you can scribble an idea on a napkin, take a picture of it, upload it to a provisional patent application, pay $300, and you now have "Patent Pending" status for the next 12-months. If you don't file the full nonprovisional (utility) patent application by the 1-yr deadline, then you loose priority.

Anyone can get patent pending on anything.

The USPTO almost never looks in the provisional application filing as its really there to reserve the date of the idea "First to File" etc.

What gets me is some OTC companies do press releases on "Patent Pending" status to drive up share price knowing full well that the chance of their patent application, if they ever file it after the provisional patent pending, has a almost no chance of ever being granted a full utility patent.

I'll take a look around to see if there's anything of substance.
