Bird, it's doubtful that the CAFC judges personally knew Du, especially considering the fact that Dyck referred to Du as 'he' three times during oral arguments!
didn't one of the judges refer to du as a 'he'? they didn't know her, and obviously didn't spend a second on reading "her" opinion and or singers rebuttal
