Meowza, The chance of having a case taken up by the Supreme Court is always low. I think this case has a better than average shot. Issues that relate to the courts invalidating patents granted by USPTO are important. There is growing controversy in the lower courts as to what is or is not permissible under law. I think SCOTUS may see this as an opportunity to clarify this problem.
The weighing of secondary indica has not been part of the debate. This action in the district court ruling could well be reason enough to move the Supreme Court to act.
