Ralphey, I agree that the case against the insurance company appears stronger. If Hikma can get the case dismissed with prejudice will that prevent Amarin's prosecution of the insurance company? As to the strength of the Hikma response, I do think it is solid. GSK v Teva could change that. If the court finds for GSK that case law should help Amarin. I think the court is unlikely to change their collective opinion however; the wording in the decision might be different. I am not a lawyer so take my opinion for what it's worth. It would surprise me if the judge dismissed before seeing the outcome of GSK v Teva.
