Cert is a Hail Mary pass...but if it is caught, we run right into the
end zone....I doubt whether SCOTUS cares much about the facts of Mori
and Kura...but they might care about the principles of Graham, which
they, themselves have elucidated on and, which were ignored in the
Federal court decision and in the CAFC.
