Bouf, Thanks for the reply. I don't have any real hope of SCOTUS hearing our appeal. I am trying to understand how they can even file. The appeal court ruled (rule 36 affirmation) What part of that can be considered an error in judgement? If we can't include the district court ruling to show the legal errors that did occur, why even file the appeal? I think we all agree that weighing the secondary indica against one another runs counter to prior supreme court rulings. If we can't present that information in the appeal petition, what's the point of filing?
