The Quantum case which is squarely on point with this case which is cited by GDSI's counsel was a Southern Florida District case decided by Judge Martinez who remains on the bench until this day. It determined that damages could be given to the purchaser if the purchaser did not get what the contract said they were getting. You can bet that Judge Middlebrooks will discuss this case precedent with Judge Middlebrooks. The defendants would not even touch that in their filing because they know it's squarely on point. They ignored it.
