Huh? Again with all due respect, you are completely off base. The post-trial findings of fact were filed roughly 30 days before the verdict was rendered.

Lawyering 101--the basic most rudimentary standard of care for any lawyer, much less highly paid specialists in patent law who are subject to an elevated standard of care--dictates that the lawyers review the submission, and then upon spotting this egregious subterfuge, write to the Court, very forcefully bringing these shenanigans to the Court's attention.

I do not know where you get this odd idea that Amarin's counsel could not have done anything. Not only could they have responded, they were duty-bound to do so. Instead, with this entire company and billions of dollars at stake, they inexplicably dropped the ball.
