Thanks as always for your invaluable feedback, alm. I agree that they will most likely, and probably prudently, build a supporting record to increase the likelihood of securing the injunction.

I don't think that Amarin is going to pursue the Rule 60 avenue in Nevada, as eight has formally requested in writing that they do so, but they have never responded. My theory is that Kennedy/Covington committed legal malpractice, and are seeking to bury this issue.

I along with the rest of the Amicus team am putting together the full gameplan for the Rule 60 operation, which has a stronger chance of success than any of the appellate avenues. Hopefully we can catch lightning in a bottle, and do something spectacular.

The actual facts, law, and merits support Rule 60 relief, but the question still remains whether Judge Du has the integrity and intelligence to do the right thing when presented with the uncropped truth.
