Did "encourage / promote" come from a statute or from judge's opinion (case law)?

As I know:

- The law (35 U.S.C. § 271(b)) does not specifically determine the meaning of inducement.

Whoever actively induces infringement of a patent shall be liable as an infringer.

- " encourage, recommend, or promote infringement" is used by courts / judges in several cases ("always"). According to a 2011 Supreme Court decision, the word “induce” means “to lean on; to influence; to prevail on; to move to persuasion.”
