The thread was just about "where is the data"...one reply is that there is 4 days to share a failure...and my response was...it had to be called a failure first and that doesn't need to be disclosed for a year...that was it. Those guidelines are from the FDA. They have 4 days from the date that it is determined a failure...not 4 days from receiving data...but if a year passes before determining it a failure, then you have a case.
Are you filing the suit to find out if it failed or not?
I also think the data will be out in December (WAG), but they could be holding onto it until they find a suitable conference and claim that they are still examining the data until then.
