Monterey 200: Good question. I don't have a real good answer as I know little about Lanham and Delaware law other than what has been discussed here. I'm not certain about the interstate commerce part, but, as a general answer, a state law violation can be heard by a federal district court, whether or not interstate commerce is involved. Federal jurisdiction can be based upon "diversity of citizenship" as well as violation of Federal Statutes or Constitutional violations.

To me, the bigger question is the type of damages that can be collected for State law violations, if any.

Not a good answer I know. Maybe one of our other eagles can help out.
