An Idea....
My experience with judges...(including Amarin) is they are arrogant and authoritarian. I have sat with them medical tribunals and they always considered themselves more knowledgeable on medical issue than I was..even though I was the MD.. And I knew how stupid they were.
Thinking this over my first response was to enlist the aid of FDA (probably too bureaucratic...The AHA...a possibility (they were there for the R-I presentation)..or some nationally recognized cardiologist like Bhatt...
The more I thought about it.. the more issues came up...Then I changed my thinking...The real answer is "Sixty Minutes"....I don't think "Sixty minutes" is going to take this on all by itself...But if we (including the Company) could get together a team including Patent experts, lawyers, Cardiologists and Experts on the FDA...We could sell the idea that the courts have given away (stolen) Amarin's property by false statements and trivialities...Which the court lacked the expertise and knowledge to understand were neither accurate nor relevant...The important thing is explain to Sixty minutes that this travesty is likely to have a chilling effect on future advances in medical science.. When future biotech companies have to decide to put up hundred of millions of dollars and years and years going through the costly FDA marketing. If a bunch of uneducated and naïve federal judges can give the fruits of their labor away to generics who use clever and fallacious arguments on judges who lack the education and experience to know they are being Bamboozled.
I think Sixty Minutes would go for this if they did not have to do the heavy lifting...I think they would love a segment that shows a case where the Federal Courts are being taken for a ride..And the ramifications are very serious when you consider the possible effects of future medical science...
Who doesn't hate judges ???
